Facts

1. Both Plaintiffs are resident of Richland County S. C.
2. Plaintiffs co- owned “Kodi” the subject and reason of this complaint.
3. The Defendants are all associated thru business and share liability.
4. Defendants place of business is within the Jurisdiction of this Magistrate’s Court.
5. This suit seeks damages within the limits of Magistrate’s Court.

Complaint

Comes now, the Plaintiffs, Jennifer Maleki and Ronald Colley and file this their complaint pro-se and says:
On March 1st 2005 Plaintiffs, took their pet dog ” Kodi” to Banfield The Pet Hospital for a check up. Within two hrs he was dead!
The Plaintiffs believe “Kodi” died due to negligence and veterinary malpractice.
South Carolina law defines pets as personal property limiting the Defendants Liability to the cost of the pet. Kodi was a full bred Pug and cost 1,200.00. Plaintiff, Ronald Colley, paid $500.00 and Plaintiff, Jennifer Maleki, paid $700.00. Pure bred pugs currently cost between $1500.00 to $2000.00.

Wherefore, Plaintiffs pray the Court will set this matter for Jury Trial where the Plaintiffs seek recovery for their monetary loss due to the Defendants Actions plus costs and punitive damages of this Action Pursuant to South Carolina law.

You need to talk to a lawyer. If all you can prove is what is in these two posts, you may not succeed. You have to show what the vet did wrong AND that it was negligent - please talk to a lawyer - not necessarily hire one, but find out exactly what you need to prove to win. Best of luck and sorry about the loss of your pet.

Good for you for filing this complaint. Do what you have to do to win. Unless the defendants admit that they gave him a shot that you, or the vet records you gave them, warned them not to give, you might need testimony from another vet, which will be difficult this long after the death.

At least make sure that what happened to you is reported everywhere that you can think of. I'll try to find out some places.

If you need another vet, I can recommend Sunset Animal Clinic (just off Sunset Blvd. across the Interstate from Lexington Medical Center) and the Van de Grift Animal Clinic on Taylor St. in Columbia.

OR..I know this is probably far away for you, but West Columbia Animal Clinic on Platt Springs Road in Springdale! My babies LOVE their Vet!!! They get excited every time I pull up there because they know they are going to get passed around and loved on for the whole day!
